PLAINTIFFS’ NOTICE OF BANKRUPTCY COURT’S ORDER TO TRANSFER ADVERSARY PROCEEDING

On September 23, 2010, the bankruptcy Court in Defendant Khachik Bagdasaryan’s (hereinafter “Bagdasaryan”) Chapter 7 bankruptcy, Cause No. 10-bk-18208-GM in the Central District of California (San Fernando Valley) (the “Bankruptcy Action”) entered an Order to Transfer Adversary Complaint from U.S. Bankruptcy Court to U.S. District Court for the Central District of California Pursuant to General Order 96-04 (the “Order to Transfer”).

A true and correct copy of the Order to Transfer is attached hereto as Exhibit “A,” and is incorporated herein by reference. Plaintiffs Plaintiffs D*SH Network L.L.C., E*hoStar Technologies L.L.C., and N*graStar LLC (collectively “Plaintiffs”) filed the transferred Adversary Proceeding against Bagdasaryan in the Bankruptcy Action on September 21, 2010, requesting the Court except Bagdsaryan’s debt to Plaintiffs from discharge under 11 U.S.C. § 523(a)(4) and 11 U.S.C. § 523(a)(6), in cause 1:10-ap-01401 in the United States Bankruptcy Court for the Central District of California (San Fernando Valley) (the “Adversary Proceeding”). A true and correct copy of the Adversary Complaint is attached hereto as Exhibit “B,” and is incorporated herein by reference.

Pursuant to General Order No. 96-04 Judge Mund has transferred the Adversary Proceeding to determine the dischargeability of Bagdsaryan’s debt to Plaintiffs back to the District Court. Judge Mund states in her Order to Transfer that now that the automatic stay has been lifted, “it is most efficient for the courts and the parties to have the civil case and the adversary proceeding handled by the same judge. The same evidence and outcome will determine both cases.”
