Mother barred from daughter's funeral

A California mother has been barred from the funeral for her 2-year-old daughter who died while in her care, officials said.

Denise Wilder of Roseville must stay 500 yards away from any "funeral and/or memorial" for her daughter after the child's father, Mark Wilder, was granted a temporary restraining order against her Monday, the Sacramento Bee reported.

The mother was also prohibited from contact with the couple's 5-year-old child.

Wilder was arrested April 4 after authorities say they found her intoxicated and her child, McKinley, dead. She was booked into the Placer County jail on suspicion of murder and child neglect, but released Monday without bail or charges while the district attorney waits for the coroner's toxicology report on McKinley.

Denise and Mark Wilder, who recently divorced, had been going through a bitter custody battle. A custody hearing that was scheduled for Wednesday morning was pushed back to April 19.

Krystal Jaime, supervising attorney for the UC Davis School of Law's Family Protection and Legal Assistance Clinic, said it is unclear whether Denise Wilder will testify in the custody hearing, as what she says could be used against her should charges be filed.

"If she provides any testimony in the restraining order trial that could be used against her," Jaime said, "that would essentially be waiving her Fifth Amendment rights."
