Suspect in Buffalo may not be 'right guy'
BUFFALO, N.Y., Erie County, N.Y., officials say they may not have arrested the "right guy" in the killing of four people at a restaurant in Buffalo.
Keith Johnson, 25, of Buffalo -- who was released from prison on parole last month -- was arrested hours after four people were killed and four others were wounded in a burst of gunfire early Saturday at a restaurant.
Erie County District Attorney Frank A. Sedita III said late Saturday video evidence suggests someone other than Johnson was responsible for the shooting. Sedita said he would probably ask the courts to dismiss charges against Johnson, the Buffalo (N.Y.) News reported.
"We are having serious second thoughts," Sedita said. "I have serious reservations about whether we have the right guy here."
Sedita said investigators notified him of the video evidence and told him they were "having serious second thoughts."
"I looked at the evidence, along with four or five detectives, and the commissioner is here as well," Sedita said. "There are certain discrepancies of people and clothing."
One of the shooting victims, James Robbs, said he didn't get a good look at the shooter but he was sure it wasn't Johnson.
Police are considering another suspect but no arrest had been made late Saturday night, the newspaper said.
The victims included Daniel Mackin, 30, a Buffalo native who had returned to the city for a party to celebrate his marriage last year in Texas. Mackin's wife, also from Buffalo, was not injured, police sources said.
Several parties were held at the restaurant Friday night, including an informal gathering for the Mackins. A formal party in honor of their wedding anniversary was to have been held later Saturday.
