TiVo, Ec**Star Back in Court Over DVR Patent Dispute
Authored by Mark Hefflinger on February 17, 2009.
Texarkana, Texas - TiVo (NASD: TIVO) and DISH Network operator Ec**Star (NASD: SATS) were back in court on Tuesday, with TiVo arguing that Ec**Star should have to pay additional damages for infringing on its digital video recorder patent, Reuters reported.
TiVo initially sued Ec**Star in 2004, and a federal court in 2006 sided with TiVo and ordered Ec**Star to pay $104 million in damages.
Ec**Star has continued to offer DISH subscribers DVR services using what it calls a "workaround" that does not utilize TiVo's patented technology.
TiVo is arguing in the current proceedings that the "workaround" still infringes upon its patents.
The company is seeking additional damages, as well as an injunction that would force Ec**Starto stop using the technology on the millions of digital video recorder set-tops deployed with its subscribers.
