An Edmonton man who fired his gun through the floor of a townhouse killing a man below was found guilty of manslaughter Thursday and sentenced to 12 years in prison.

Court of Queen's Bench Justice Adam Germain called the testimony of Jason Seruhungo, 22, implausible and nonsensical.

Germain gave Seruhungo credit for the time he has already spent in custody, meaning he will serve eight years and eight months behind bars.

Seruhungo was at a townhouse near 180th Street and 98th Avenue on Oct. 22, 2009 when he fired a bullet through the floor during a confrontation.

Edward Wilson, 22, who was in the basement, was hit in the head and later died in hospital.

Seruhungo testified others at the house pulled their guns first and he only fired his gun in self-defence. The judge rejected the claim, concluding Seruhungo was the only person with a gun drawn.

The case was not self-defence, but manslaughter, he said.

Before he was sentenced, Seruhungo told the court he was sorry for firing the shot that killed Wilson. He said he would serve as an example to encourage his nephews to stay away from gangs and drugs.

"It's not worth it," he said. "Nothing is worth this."

That decision came as a relief to Wilson's family, said his uncle Jason Phillip.

"The prosecutor is forever in my heart," Phillip said. "That guy did justice for Eddy."

The tight-knit family will make sure Wilson's two young daughters will know their father, he said.

"Those two girls are going to grow up with just memories of what we say about what Eddy is about."

"I'm just going to miss him," said Phillip.
