Child porn at work nets 5 months jail

A Winnipeg man who downloaded child pornography on a work computer will spend the next five months in jail.

Ryan Garrioch, 30, came into court Thursday hoping to be able to serve his sentence for possession of child pornography on weekends.

But provincial court Judge Kelly Moar refused that request and ordered him off to jail.

Garrioch was arrested in June 2007 after a co-worker found suspicious files on an in-house computer at a local cellular and wireless communications company.

A company forensics team was called in and discovered five images and a number of videos of child pornography. They identified Garrioch as the person who downloaded the files and called police.

A subsequent search of his home netted investigators further small quantities of child pornography from two discs. A computer without a hard drive was also seized.

Garrioch, who had been out on bail since his arrest and had no prior criminal record, pleaded guilty just before a preliminary inquiry into a charge of possession of child pornography was set to begin.

A psychologist's report presented in court stated Garrioch is a low risk to reoffend and does not have pedophilic tendencies.

At a prior hearing, Garrioch told Moar he was ashamed of his actions, but the judge suggested Thursday that he wasn't completely convinced of his remorse. For example, Moar said, Garrioch didn't immediately seek psychological help or counseling after his arrest.

"One cannot find any overt sign of remorse until the guilty plea is entered," Moar said.

After he serves his jail time, Garrioch will be on probation for three years. Conditions of that probation include not being alone with children under the age of 16 and not possessing a computer or device that can access the internet.

His name will also be placed on a federal sex-offenders database, where it will remain for the next 10 years.
