The jury hearing testimony in the second-degree murder trial of Gordon Hurley was shown this picture of the victim, Jarita Naistus, with her boyfriend Myron Smith, one day before the woman was killed.


A man appearing as a witness in a second-degree murder trial has been accused of killing the victim by the defence lawyer.

Gordon Hurley, 46, is on trial, in Battleford, Sask., accused of killing Jarita Naistus in 2005 in a motel room in Lloydminster.

On Friday, the jury heard testimony from Myron Smith who said he was with the victim prior to her death and was her lover.

During cross-examination, Hurley's defence lawyer — Morris Bodnar — accused Smith of killing Naistus.

Bodnar noted that DNA from Smith was found on a cigarette left in a bottle in the motel room, and shows Smith was with the victim, after Hurley left the room.

Smith denied Bodnar's accusation.
